We are a Canadian-based company dedicated to providing top-quality cleaning supplies and accessories for auto detailing, janitorial needs, and industrial applications. By accessing or using our website (the “Site”) or purchasing any products from us, you agree to be bound by these Terms of Use (“Terms”). These Terms govern your use of the Site and all related services, features, and content offered by NextGen Cleaning Supplies (collectively, the “Services”).

1. Acceptance of Terms

By using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Services on behalf of a company, organization, or other legal entity, you represent that you have the authority to bind that entity to these Terms. If you do not agree to all of these Terms, please refrain from using the Services.  

2. User Eligibility

To use the Services, you must be at least 18 years old and have the capacity to enter into legally binding contracts. You may not use the Services for any illegal or unauthorized purpose.

3. Modifications to Terms

We reserve the right to modify these Terms at any time without prior written notice. You are responsible for checking these Terms periodically for changes. Your continued use of the Services following the posting of any changes to the Terms constitutes acceptance of those changes.  

4. Orders and Payment

4.1 Placing Orders

You can place orders for our products through the Site. To place an order, you will need to provide accurate and complete information, including your name, shipping address, billing address, email address, and phone number.  

4.2 Payment Methods

We accept various payment methods, including major credit cards and debit cards. You agree to pay the total amount for your order, including any applicable taxes and shipping charges.

4.3 Order Confirmation and Availability

Once you place an order, we will send you a confirmation email with details of your purchase. We reserve the right to cancel your order if a product is unavailable or the pricing information is incorrect. In such cases, we will notify you by email and provide a full refund.

5. Shipping and Delivery

5.1 Shipping Costs and Timeframes

Shipping costs and delivery times are based on the items ordered, your location, and your chosen shipping method. We will provide you with shipping options and estimated delivery times during checkout.

5.2 Risk of Loss

All items purchased are shipped pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.  

6. Returns and Refunds

6.1 Return Policy

We offer a return policy for unused and unopened products within 30 days of purchase. To initiate a return, please contact our customer service team by phone (+1 647-553-7860) or email (Info@nextgencleaningsupplies.com). You will be provided with a return authorization number (RAN) and instructions for returning the product.

6.2 Return Shipping

You are responsible for the cost of return shipping unless the return is due to our error. We recommend using a trackable shipping service for your return.  

6.3 Refunds

Once we receive your returned product and verify its condition, we will process your refund within 10 business days. Refunds will be issued to the original payment method used for the purchase.  

7. User Content

The Services may allow you to submit content, such as reviews, comments, or questions (“User Content”). You are solely responsible for any User Content you submit. You represent and warrant that you own all rights to your User Content or have obtained all necessary permissions and licenses to use it.

8. Intellectual Property

The Services and all content on the Site, including text, graphics, logos, images, and software, are the property of NextGen Cleaning Supplies or its licensors and are protected by Canadian and international copyright and trademark laws.

9. Third-Party Links

The Services may contain links to third-party websites or services that are not owned or controlled by NextGen Cleaning Supplies. We are not responsible for the content or practices of any third-party websites or services.  

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NEXTGEN CLEANING SUPPLIES DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR VIRUS-FREE.  

11. Limitation of Liability

NEXTGEN CLEANING SUPPLIES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF NEXTGEN CLEANING SUPPLIES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.  

12. Indemnification

You agree to indemnify and hold harmless NextGen Cleaning Supplies, its officers, directors, employees, agents, and licensors from and against any and all claims, losses, liabilities, expenses, including attorney fees, arising out of or related to your use of the Services or your violation of these Terms.  

13. Termination

We may terminate your access to the Services at any time, with or without cause, and without notice. You may also terminate your access to the Services at any time, by discontinuing your use.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, ¹ without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms will be subject to the exclusive jurisdiction of the courts of Canada.
